1. The agreement
These Individual Terms, the Subscription Terms, Acceptable Use Policy, Privacy Notice and any terms shown at checkout form the agreement between you and the Ekadem operator shown in the Legal Notice. If checkout gives you a specific price, period or promotion, that specific term controls.
By creating an account or using Ekadem, you agree to the version presented to you. If you use a school-managed workspace, the school’s Order Form and School Service Terms govern that workspace and take priority for school data.
2. Account types
- Free provides limited personal learning features and allowances.
- Plus is the paid personal plan, currently listed at US $7 per month before applicable tax, with the storage and AI allowance shown before purchase.
- Teacher is the paid individual teacher plan, currently listed at US $13 per month before tax, with up to 10 classes and 300 distinct students under current product limits.
- School is institution-managed and requires a separate school agreement. An individual Teacher plan does not give Ekadem the school’s authority to process student records.
Allowances, supported file types and feature details are shown in Plan & limits and may be adjusted under section 12. “Unlimited” means subject to fair, lawful use, service protection and any Order Form.
3. Eligibility and accounts
You must provide accurate account information and protect your credentials. A person buying a plan must be at least 18 or the age of legal capacity where they live. A direct account is not for a child under 13. A minor aged 13 or older needs the parent, guardian or other authorization required by local law. School-managed students use Ekadem under school authority rather than buying a plan.
You are responsible for activity under your account until you report compromise. Do not share credentials, impersonate someone else or avoid an account restriction. Tell security@ekadem.com promptly about unauthorized access.
4. What Ekadem provides
Ekadem helps people create, organize, study, teach, collaborate and receive feedback on learning materials. It includes user-created content, optional integrations and AI-assisted features. We will provide paid digital services with the conformity and updates required by mandatory consumer law. The service may evolve, but we will not remove the core value of a current paid period without a legitimate reason and the notice or remedy the law requires.
Ekadem is an educational tool, not an accredited school, records custodian for personal accounts, emergency service, or source of medical, legal or other professional advice.
5. Rules for individual teachers
If you teach through an individually purchased account, you confirm that you have authority from your school or organization before entering student names, emails, work, grades, voice or other student information. If the institution is the responsible controller or educational agency, ask it to establish a School workspace and agreement first.
- Give students and families the notices your institution and law require.
- Invite only the students you are authorized to teach and remove access when it ends.
- Do not use personal accounts to avoid procurement, a school DPA, parental rights, public-records duties or an institutional AI policy.
- Review all generated feedback and scoring suggestions. You—not the model—make educational decisions.
- Do not require a student to buy a personal subscription to participate in a class unless the school has lawfully approved that arrangement.
6. Your content
You keep ownership of content you create or upload. You give Ekadem a worldwide, non-exclusive, royalty-free license to host, copy, display, transmit, convert, index and otherwise process it only as needed to provide, secure, troubleshoot and support the service. This license ends when the content is deleted from active systems, subject to backup expiry and legal retention.
You confirm that you have the rights and permissions needed for your content. Do not upload confidential or sensitive data that the feature and account type are not approved to handle. If you make content public or share it by link, people with access may view or copy it; choose sharing settings carefully.
7. Safe and lawful use
Use Ekadem only lawfully and follow the Acceptable Use Policy. In particular, do not harm children, harass people, expose private records, infringe rights, upload malware, bypass security or plan controls, scrape private data, resell access without permission, or use the service to create illegal material. We welcome good-faith security research reported privately.
8. AI features
AI output is probabilistic and can be inaccurate, incomplete or biased. Check important claims and keep a qualified person in control. Do not use Ekadem as the sole basis for admission, final grades, discipline, special-education eligibility, employment, credit, housing, medical care, legal rights or safety decisions. Prohibited education-sector uses include emotion recognition, social scoring and unlawful biometric categorization. More detail appears in the AI Transparency Notice.
9. Plans and cancellation
Paid plans renew automatically until canceled. The checkout page shows the price, currency, tax treatment, billing period and promotion before you commit. Stripe processes payment. You can manage or cancel through Plan & limits and the Stripe customer portal. Cancellation normally takes effect at the end of the current paid period unless checkout or mandatory law says otherwise.
On the free plan, an account that teaches may run one class for as long as the account exists, with an AI allowance for its first month of teaching and one further allowance after that, which does not renew. When an allowance is used up, AI features pause and the class keeps working. More than one class requires the Teacher plan. If a paid plan ends, classes beyond what your plan includes become read-only; existing content remains available. Read the Subscription Terms for refunds, EU withdrawal and the model form.
10. Ekadem materials
The service, software, interface, trademarks and Ekadem-created materials are protected by intellectual-property law. We give you a limited, revocable, non-transferable right to use them during your account term. You may not copy, sell, reverse engineer or create a competing service from non-public parts except where law gives a non-waivable right. Feedback is voluntary; we may use it without identifying you or taking your confidential content.
11. Suspension and ending use
You may stop using Ekadem and request deletion at any time. We may narrowly restrict or suspend an account for non-payment, credible security risk, illegal content, child-safety risk or material/repeated breach. We give notice and an explanation when reasonably possible, preserve appeal access where required, and avoid removing more content or access than necessary. Urgent threats may require immediate action.
At subscription end, personal content remains subject to the retention schedule and available product controls. An expired individual Teacher workspace may become read-only rather than being immediately deleted. School data follows the school agreement.
12. Changes to terms, service and price
We may update these terms for law, security, product or business changes. Material changes receive reasonable advance notice and take effect prospectively. If a change materially disadvantages a consumer during a paid period, applicable law may give a right to reject, terminate or receive a remedy. Price changes apply no earlier than a future renewal after clear advance notice; silence alone is not used as consent where separate consent is required.
13. Service promises and disclaimers
We will use reasonable care and skill and honor mandatory statutory rights. Except for promises that cannot legally be excluded, the service is provided “as available”; we do not promise uninterrupted operation, that every generated result is correct, or that user content will achieve a particular educational outcome. Beta features are identified and may change more often. Nothing here limits legal guarantees or remedies for digital services that apply to consumers.
14. Responsibility if something goes wrong
Nothing excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, violation of non-waivable privacy rights, or any liability that law does not allow us to limit. For other claims, each party is responsible for reasonably foreseeable direct loss caused by its breach. To the extent law permits for a business user, Ekadem’s total aggregate liability under an individual account is limited to the greater of US $100 and the fees paid for that account in the 12 months before the event. Consumer rights and remedies remain unaffected.
15. Governing law and disputes
The governing law and courts are those of the operator’s registered office, but this does not remove mandatory protections or the right of a consumer to bring a claim in the courts available under their local law. We do not require individual arbitration or a class-action waiver in these terms. Contact hello@ekadem.com first and we will try to resolve the issue.
For German consumers, the operator must state in the Legal Notice whether it is willing or obliged to participate in consumer conciliation. The former EU Online Dispute Resolution platform was discontinued in 2025 and is not presented as an available route.
16. Contact and contract details
General and contract support: hello@ekadem.com
Privacy: privacy@ekadem.com
Security: security@ekadem.com
The contracting entity, address, registration and VAT details must appear in the Legal Notice. If one part of these terms is unenforceable, the remaining parts continue. A failure to enforce once is not a permanent waiver.
